These terms govern how you use ifever. We have written them as clearly as we can.
These terms apply to all contracts between you and Apex Ventures Tech LLC ABN [00 000 000 000] [Street and number] [Suburb State Postcode] Australia (“we”).
Our service is for people aged 18 and over.
ifever is a digital vault. You can store documents, login details and letters in it, encrypted. You decide who gets which contents and who must confirm that you have died or can no longer make decisions. Regular check-ins show that you are fine.
We only release contents when your trusted people confirm it. A missed check-in on its own releases nothing. If a trusted person says you are fine, we stop the process. If a release starts, we tell you so you can cancel it.
You can send a test release to yourself at any time.
ifever is not legal advice. We do not write wills and we do not check whether your documents are legally valid. We store copies. A copy does not replace the original. Keep your signed original will in a safe place, such as with your solicitor, and tell your executor where it is. The guides on our website are general information only.
This is the part that matters most, and we would rather over-explain it than have you discover it later.
ifever must not be your only plan. It is a way to make sure the right people can find what you left them, not a replacement for a properly made estate plan.
The contract is formed when you finish signing up with “Create account” and choose a plan. Before that you can check and correct your details. We send you a confirmation by email.
Please keep your details up to date, especially your email address and mobile number. Keep your password secret.
The prices on our pricing page at the time of ordering apply. All prices are in Australian dollars and include GST.
On the monthly plan you pay monthly in advance, on the yearly plan yearly in advance. We accept [payment methods].
Each paid plan includes a second vault for your spouse or de facto partner at no extra cost. Your partner’s vault is separate and private. You cannot see its contents and your partner cannot see yours.
If your plan ends, we will email you and your partner before anything changes and give your partner the chance to keep their vault. [Describe the rule precisely before launch.]
If a payment fails, we do not lock your vault. Check-ins, reminders and releases carry on. We get in touch and ask you to make the payment.
[Optional: rule on when, and with what notice, we may end the contract after lasting non-payment.]
ifever is free for recipients and trusted people. They do not enter into a contract with us and never pay anything, including for opening released documents. There are no fees per document.
Monthly plan: the contract runs until you cancel. You can cancel at any time, effective at the end of the current month.
Yearly plan: the first term is 12 months. After that the contract continues until you cancel. You can cancel at any time, and your plan runs until the end of the period you paid for.
You can cancel in your account or by email to support@ifever.com.au.
After the contract ends you can still download your contents for [30] days. Then we delete them.
If you are not satisfied, tell us within 30 days of your first payment and we will refund that payment in full, to the payment method you used.
This guarantee is in addition to your rights under the Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
A gift covers 12 months of ifever, including a vault for the recipient’s partner. The recipient redeems it with the link we email them. [State expiry, refund and transfer rules before launch.]
Choose your trusted people carefully and tell them beforehand. Only store contents that you lawfully own and may pass on.
We make sure ifever is available with as few interruptions as possible. We announce maintenance in advance where we can.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, we are not liable for indirect or consequential loss, for trusted people giving false information, or for the legal validity of your documents. Where the law allows, our liability for a breach of a consumer guarantee is limited to resupplying the service or paying the cost of having it resupplied.
How we handle your personal information is explained in our privacy policy.
We tell you about changes to these terms by email at least 30 days in advance. If you don’t agree, you can cancel before they take effect and request a refund for any unused period.
These terms are governed by the laws of [State or Territory], Australia. You and we submit to the non-exclusive jurisdiction of the courts of [State or Territory].
If any provision of these terms is invalid, the rest remain valid.
